Terms of Service

These Terms of Service ("Terms") govern your use of the Sawa mobile application ("App") operated from Switzerland. By creating an account, you agree to these Terms. If you do not agree, please do not use Sawa.

1. Eligibility

You must be at least 18 years old to use Sawa. By signing up, you confirm you meet this requirement and that you have the legal capacity to enter into this agreement.

2. Your account

You agree to provide accurate information during signup and to keep your account credentials secure. You are responsible for all activity that occurs under your account. One person, one account — creating multiple accounts per user is not permitted.

3. Acceptable use

When using Sawa, you agree not to:

• Harass, threaten, stalk, or discriminate against other users.
• Send sexually explicit content, hate speech, or other illegal content.
• Impersonate anyone else or misrepresent your identity.
• Use Sawa for commercial solicitation, spam, or unsolicited promotional content.
• Attempt to reverse-engineer, scrape, or interfere with the App's technical operation.
• Meet any other user in a way that creates a reasonable risk of harm to yourself or others.

Violations may result in warning, temporary suspension, or permanent account termination without refund.

4. Matched groups and offline meetups

Sawa facilitates introductions between strangers for the purpose of friendship. Any decision to meet another user in person is entirely your own, and you are solely responsible for your safety. Sawa does not conduct background checks on users and is not liable for any interaction between users, whether online or offline. Use common sense: meet in public spaces, tell someone where you are, and trust your instincts.

5. Activity suggestions and affiliate links

The Suggestions tab and certain chat messages contain third-party activities, events, and services ("Offers") provided by partners such as GetYourGuide, Ticketcorner, Eventfrog, and others. When you tap an Offer, you are redirected to the partner's website to complete the booking. Sawa may earn an affiliate commission at no additional cost to you. All bookings, payments, refunds, cancellations, and customer support for Offers are handled by the respective partner, not by Sawa. Sawa is not responsible for the content, quality, price, availability, or performance of any Offer.

6. Content you post

You retain ownership of messages, photos, videos, and voice messages you post in Sawa. You grant Sawa a limited, worldwide, non-exclusive license to store, transmit, and display that content solely for the purpose of providing the service. We do not sell your content to third parties.

You warrant that any content you post does not infringe the rights of others and complies with applicable laws.

7. Service availability

Sawa is provided "as is" and "as available". We may modify, suspend, or discontinue features at any time, with or without notice. We do not guarantee that the matching process will find a group for every user, that the App will be error-free or uninterrupted, or that any specific uptime will be met.

8. Limitation of liability

To the maximum extent permitted by Swiss law, Sawa's total aggregate liability to you for any claim arising from or related to these Terms or the App is limited to CHF 100. Sawa is not liable for indirect, incidental, consequential, special, or punitive damages, including without limitation damages arising from offline meetups between users, third-party Offers, loss of data, or loss of profits.

9. Termination

You may delete your account at any time from the in-app settings. We may suspend or terminate your account for breach of these Terms or for any behaviour that we reasonably believe is harmful to other users or to Sawa. Upon termination, your right to use Sawa immediately ceases. Sections 5, 6, 8, 10, and 11 survive termination.

10. Governing law and jurisdiction

These Terms are governed by the laws of Switzerland, excluding its conflict-of-laws rules. Any dispute arising out of or related to these Terms will be resolved in the competent courts of Zurich, Switzerland, unless Swiss consumer-protection law grants you a more favourable forum.

11. Changes to these Terms

We may update these Terms from time to time. Significant changes will be notified in-app at least 14 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
